1. About these terms
These terms apply when you use the LegacyData by Kamyab website or hire us for a service. LegacyData is operated by Kamyab Infotech (New Delhi and Mumbai, India). By booking a service or paying for one, you agree to these terms together with our Privacy Policy, Data Handling Policy, Data Retention & Deletion Policy, Refund & Cancellation Policy, Customer Authorization & Migration Terms and Data Recovery Disclaimer.
2. What we do
We help families locate, safely read, consolidate, migrate and verify data from old devices such as laptops, desktops, phones, hard drives, USB drives and memory cards. The services are listed on the services page. A typical project moves through assessment, safe reading, inventory, consolidation, migration, verification, your review, and secure deletion of our temporary copies.
We are not primarily a data-recovery lab. Recovery work is offered only after an assessment, and is covered by the Data Recovery Disclaimer.
3. Your data stays yours
- You own your data. Nothing in these terms transfers any ownership of your files to us.
- You choose the destination: a drive you supply or buy through us, or a cloud account that you own and control.
- We do not use your private files to train AI, and content-level AI inspection is not enabled by default.
- Our staff do not casually browse your files. They open or view content only when needed to copy, organise as you requested, or verify it.
4. Quotes and pricing
Prices shown on the website are starting prices in Indian rupees. The final price depends on the number of devices, the total amount of data, device condition, complexity, the destination, and how much organisation you ask for. We give you a written quote before work begins, and work starts only after you accept it. Taxes such as GST are shown in the quote where they apply.
If we discover something during the work that changes the scope, such as an extra device or a failing drive, we will tell you and ask before doing anything that changes the price.
5. Payments
Payments are made online through Razorpay or by another method we agree with you in writing. We never store your card details. Typical stages are an assessment fee, a booking deposit, and a balance due on completion. Refunds are covered in the Refund & Cancellation Policy.
6. Your responsibilities
- Give us accurate information about the devices and what you want done.
- Make sure you own the devices and data, or are authorised to hand them over. See the authorization terms.
- Provide passwords or access for encrypted or locked devices when we ask, and change them afterwards.
- Review the migrated data promptly and tell us about any problems.
- Verify your migrated data before you destroy, erase, sell or recycle any source device. Keep the original devices until you are satisfied.
7. Timelines
Dates we give are estimates. Reading old or slow devices, large volumes of data and delays in your approvals can all affect timing. We will keep you informed through your status page and by email.
8. Completion and review
When migration and verification are done, we ask you to review the result. Any balance becomes due. Temporary working copies are then kept for the retention period agreed in your project (30 days after completion by default) and securely deleted, after which we issue a deletion certificate.
9. Devices left with us
We track devices with chain-of-custody records from receipt to return. Please collect your devices once we tell you they are ready. If devices are not collected, or cannot be delivered, within a reasonable time after repeated notice, we will contact you about the options before taking any further step.
10. What we do not promise
We work carefully, but some outcomes are outside anyone's control. Devices that are old, damaged or failing can stop working at any moment, even during a gentle read. We do not guarantee that every file on every device can be read or recovered. Where we cannot read something, we will tell you clearly.
11. Limit of liability
To the extent the law allows, our total liability to you for any claim arising from a service is limited to the fees you paid us for that service. We are not liable for indirect or consequential losses, or for loss caused by a device failing because of its pre-existing condition after we warned you of the risk.
Nothing in these terms excludes or limits liability for gross negligence or wilful misconduct, or any liability that cannot lawfully be excluded under Indian law. Your statutory rights as a consumer are not affected.
12. Acceptable use of the website
Please do not misuse the website, attempt to break into it, submit false information, or use it to handle devices or data you have no right to. We may block access if we see abuse.
13. Changes
We may update these terms. The version in force when you accepted your quote applies to that project unless both of us agree otherwise.
14. Governing law and disputes
These terms are governed by the laws of India. Courts at New Delhi have jurisdiction, subject to any rights you have as a consumer to approach a forum nearer to you. Before any formal step, please write to aj@kamyab.co.in so we can try to resolve the matter. Most concerns can be settled this way.
