Customer Authorization & Migration Terms

What you confirm and authorise when you hand devices to LegacyData by Kamyab: ownership or permission, copying to your destination, encrypted devices.

1. Why we ask for this

Old devices often hold other people's memories as well as yours: a spouse, children, parents, or relatives who have passed away. Before we touch anything, we need to be sure that you have the right to ask us to do so. These terms record what you confirm and what you permit.

2. What you confirm

By accepting a quote or handing over a device, you confirm that:

  1. You own the devices and the data on them, or you are properly authorised by the owner to hand them over and to ask for the work.
  2. The information you gave us about the devices and the work you want is accurate to the best of your knowledge.
  3. The data is not something you have no right to hold or copy, and you are not asking us to access anyone else's accounts or devices without their permission.

3. Devices belonging to family members

If a device belongs to a parent, spouse, adult relative or another family member, we need their permission. Please tell us about this when you book.

4. Devices of someone who has died

We understand that families often come to us after a loss. If the owner has died, you confirm that you are a legal heir, or are acting with the permission of the legal heirs. We may ask for a simple declaration to this effect, and in some cases supporting documents, such as a death certificate, a legal heir certificate, or a family consent. We ask this to protect the deceased person's privacy and your family, not to make things harder. We handle such projects with extra care and discretion.

5. What you authorise us to do

You authorise Kamyab Infotech, through its staff working on your project, to:

  • Inspect the devices physically and check their health.
  • Read and copy data from the devices to a working area and then to the destination you choose.
  • Open or view files only as needed to copy, organise as you requested, and verify them.
  • Hold temporary working copies for the retention period agreed in your project (30 days after completion by default), after which they are securely deleted and a deletion certificate is issued.
  • Use cloud logins or device passwords that you share, only for the project.

This permission is limited to your project. It does not allow us to use your files for anything else. Your data remains yours; we do not use private files for AI training, and content-level AI inspection is not enabled by default.

6. A non-destructive approach

We aim not to change or delete anything on your source devices. We copy, we do not move. You understand, though, that connecting and reading old devices carries some inherent risk, especially for failing hardware, which may stop working during any use. Where we see that risk, we will tell you and ask before going further.

7. Encrypted and locked devices

Devices protected by a password, PIN, BitLocker, FileVault or device encryption can be read only if you supply the access. We do not break or bypass encryption. If you cannot supply access, we may not be able to read the device, and the quote will say how this affects charges. Please change any password you shared with us after the project is completed.

8. Cloud destinations

If you choose a cloud destination, such as Google Drive, OneDrive or iCloud, the account must be yours, or one you are authorised to use. Please check that it has enough storage. Free storage limits are often much smaller than people expect. We will use access only for migration, and you can remove it afterwards.

9. Your review and responsibilities

After migration, we ask you to review the results. Please verify the migrated data before you destroy or erase any source device. Once you have done so, the choice about what to do with the old devices is yours.

10. Withdrawing authorisation

You may withdraw your authorisation at any time by writing to aj@kamyab.co.in. We will stop work, return your devices, and handle charges under the Refund & Cancellation Policy.

11. If you cannot give these confirmations

If you are unsure whether you have the right to ask for the work, please write to us before sending anything. We would rather talk it through than have a problem later.
