1. The honest version
We cannot promise to recover data from physically damaged or failing storage. Nobody honestly can. Sometimes a drive that clicks still gives up most of its files. Sometimes a drive that looks fine does not. This page explains how we handle that uncertainty.
2. LegacyData is mainly about preservation
Most of our work is gathering, copying and verifying data from devices that still work, before they fail. Recovery from damaged media is a separate kind of work. It begins only after an assessment, and is quoted separately.
3. What cannot be guaranteed
- Recovery of any particular file or folder.
- Recovery from physically damaged media, such as drives that click, grind or are not detected, devices damaged by water, fire or electrical surges, or memory cards with broken connectors.
- Recovery of data that has been overwritten, or removed with secure-erase tools.
- Reading of devices that are encrypted when the access has not been supplied.
- That files that can be recovered will be complete or open properly.
4. The risk of further damage
Using a failing drive can make it worse. Spinning up a drive with damaged heads can scratch the surface, and even a gentle read can be the last thing a weak drive ever does. Some recovery steps, such as opening a drive, require specialised equipment and carry a risk of permanent loss. Please do not try to repair a failing device yourself, run repair tools on it, or keep switching it on to test it.
We aim to minimise risk, but we cannot remove it, and you accept that some risk exists whenever a damaged device is used.
5. We stop and ask before risky steps
If a step could reduce the chance of recovery or damage the device further, we will stop and ask you first. We will explain the risk in plain language, the options, any extra cost and the possible result. We will not go ahead until you agree.
6. Charges
Our quote will state how recovery work is charged. Where the quote says you are not charged for recovery that did not succeed, you will not be charged for it. Otherwise, you pay for the work performed, which is explained in the Refund & Cancellation Policy.
7. Reporting
We will tell you what we could and could not read, as clearly as we can. We will not hide failures behind vague language.
8. Your own backups
Verify your migrated data before you destroy or erase source devices. Keep more than one copy of what matters to you, using the 3-2-1 idea: three copies, on two different kinds of storage, with one kept somewhere else. Our free checklist can help you plan.
9. No effect on your legal rights
